Conditions of Sale:

1. Buyer should take the kitten/cat to a veterinarian for a health check within the first 2 weeks (10 business days). If the veterinarian finds the kitten/cat to be unhealthy with an infectious disease that the veterinarian reasons was likely incubating or present before the kitten/cat was delivered, the kitten/cat may be:

In either situation the buyer must notify Helen Montague of the kitten/cat falling ill within 48 hours of the first trip to the veterinarian. Please note this clause is meant to cover infectious disease and does not cover such things as adverse drug reaction (for example vaccine reaction). .BUYER MUST BE SURE TO KEEP THE KITTEN/CAT FROM CONTACT WITH ANY OTHER CAT OR KITTEN THAT HAS NOT BEEN TESTED AND FOUND NEGATIVE FOR FIV AND FELV. IF THIS IS NOT DONE THE KITTEN/CAT CANNOT BE RETURNED TO KADIZ CATTERY. For a kitten/cat replacement, I require a FeLV/FIV test to come back normal on all cats/kittens in the buyers household before a kitten/cat will be replaced. Kadiz Savannahs in turn will provide a FeLV/FIV test to confirm a negative result on the replacement kitten/cat before it is delivered to the buyer. Buyer of kitten/cat stated within this contract has the right to receive health records from the vet/vets that the kitten has seen before going to the new home of the buyer listed within this contract. If the buyer listed within this contract seeks a replacement kitten/cat due to illness or untimely death per agreement in this contract seller Helen Montague will require the name of all veterinarians that have seen and/or treated the kitten/cat listed in this contract including their addresses, phone numbers and the release of all health records concerning the kitten/cat listed in this contract.

2. If the kitten/cat should be documented within the first year of life to have a health-impairing congenital or genetic defect, the kitten/cat can be returned and replaced with a kitten/cat of the same generation when there is one available.

3. If the kitten/cat receives a FIP vaccination (the safety and effectiveness is at this time is controversial and not proven), the health guarantee in this contract is null and void. If the kitten/cat receives a FeLV vaccination the health guarantee in this contract is null and void. If the kitten/cat listed within this contract receives more than the recommended vaccines (to be stated within each individual contract), the health guarantee listed within this contract is null and void.

4. Buyer agrees to provide this kitten/cat a good and loving home.
Buyer agrees that if the cat is found to be legally mistreated or neglected at any time (for example by animal control) that the seller regains legal ownership of the kitten/cat and that the kitten/cat must be returned without refund.
Buyer agrees to keep the kitten/cat up to date on all vaccines and other preventative medical care agreed on with the buyer's veterinarian of choice, and the buyer will make sure that medical attention and treatment is given if necessary.

5. Buyer agrees to only take the kitten/cat outdoors while restrained by a suitably fitting collar/harness and leash. Servals have home territories of many miles, Savannahs may well inherit the tendency to wander dangerously far.

6. Buyer understands that a change in diet may result in sickness of the kitten/cat that would not be the fault of the seller. If you wish to change foods please do so gradually. This kitten/cat is currently eating____________________________________________________________.

7. Buyer is responsible to research legality of owning and housing a Savannah within the city, county and state where the kitten/cat listed in this contract will be living. If false information is given to Helen Montague knowingly or unknowingly regarding this issue, the payment in whatever form received that is applied towards the purchase of the kitten/cat listed in this contract will not be refunded. The buyer listed in the contract agrees and states that the kitten/cat listed in this contract is legal to own at the address listed in the contract for the buyer in this contract and there are no special housing/permits required at the address listed above of the buyer listsed in this contract. Buyer understands that some States have laws restricting hybrid cats. These States include (but may not be limited to): GA, CT, NY, MA. Please avoid travel to these States with the kitten/cat.

8. Buyer agrees not to remove the canine teeth of this kitten/cat. Kittens/cats are not to be declawed. If a declaw is considered necessary Helen Montague must be contacted to discuss the issue before the declaw is to take place. There is a technique for removal of each individual claw that may be accepted as a last resort.

9. Buyer understands that this kitten/cat is big for its age as compared to a domestic kitten/cat and so needs gentler treatment than would be needed for a domestic kitten/cat of the same age.

10. Seller guarantees that this kitten/cat is an_________________________________________________________________________________.

11. Breeding female: Buyer agrees not to have more than 2 litters per year from this female and to retire and spay her by the age of 9 years. Buyer agrees to allow the cat daily access to an area large enough to run and play in, at least 12x12 feet.

12. Breeding female/male: Resale or lease of this breeding female or male is not allowed. In the event the cat/kitten must be permanently rehomed, it must be spayed/neutered and placed in its new home as a pet, and Helen Montague must be notified in writing of this event. Helen Montague must also approve in writing the new home of said kitten/cat being rehomed.

13. If a cat/kitten is purchased as a pet and not as a breeding female/male, Helen Montague must receive proof of spay/neuter by 7 months of age. If this proof is not received by 7 months, the female/male kitten is assumed to be a breeding female/male, and Helen Montague must receive full breeding price of sold female/male as listed per agreement on the contract. In the case of a males F2 through F4, even though fertility is unlikely, proof of neuter must be received by 7 months of age, and if not received, Helen Montague will receive a fee listed per agreement on the individual contract. Exception to this is if the spay/alter would endanger the health of the kitten/cat sold, and in this case, Helen Montague must receive a written explanation from a certified veterinarian of the buyers choice when the kitten/cat has reached 7 months of age

14. If in my opinion ( Helen Montague - Seller) decides that the health or welfare of the kitten/cat listed within this contract is in jeopardy at any time before delivery, Helen Montague retains the right to dissolve the contractual agreement, refund the money that has been received for the kitten/cat listed within this contract, and the contract becomes null and void.

15. The kitten/cat listed within this contract is not to be resold or brokered as a LIFESTYLE PETS or otherwises called an ASHERA CAT/KITTEN, or to be resold for any amount over the price listed within this contract. If it is found out that the Savannah listed within this contract has been resold without speaking first to Helen Montague the original owner Helen Montague retains the right to reclaim the Savannah listed within this contract at no expense to Helen Montague, and other parties to pay for all shipping fees and expenses regarding the reclaiming of the Savannah.

16. I request that if photos or any other media format is used commercially or non-commercially for profit or non-profit of the kitten/cat listed within this contract, the name of Kadiz Savannahs is to be included out of courtesy.

17. The purchaser listed within this contract agrees to stay in contact with the seller Helen Montague and keep her updated on the status of the kitten/cat listed within this contract and provide the new address and phone number of the buyer listed within this contract.

18.  The purchaser listed within this contract agrees that he/she is at least 21 years old.


Guarantees:

This document is the entire agreement. No other representations or statements are part of the guarantee. The jurisdiction of this contract is Jackson County, Oregon. Any condition or factor not addressed by this contract will be considered to not be covered by this contract, and the remedies of this contract do not apply.
